What happens to you if you’re charged with murder? Obviously, if you’re charged with murder, you’re going to be taken into custody. You’re going to be held in jail until such time as you have a bond hearing.
A Magistrate at the jail cannot set your bond; if there’s another charge, many times they’ll take someone in front of the Magistrate and then the Magistrate sets bond, or doesn’t, on the minor charges. So, for example, somebody could be charged with having a firearm, which could be illegal, and they could be charged with that and bond could be set on that, but it’s really meaningless because the Magistrate can’t set the bond [on the murder charge]. So, then someone has to arrange for you to be taken to court to have a bond hearing in front of a circuit court judge.
There are several factors that are involved in whether or not you can be released: whether you a flight risk, whether you’re a danger to the community. The alleged victim’s family has to be notified, and it usually takes about a week or more, if you have a lawyer working on it, to get you to a bond hearing. If no one is working on it, if you’re just in jail the public defender may not even be aware of it for a week or two, and it could take 6 weeks, easily, to even go in front of a judge. If the judge denies the bond, then you’re going to be held in jail until such time as bond is set, again.
Many times, bond is denied and then that’s the end of it, and so you could easily sit in jail for one year, for two years, we’ve seen people sit in jail four years before their trial. Those are a little bit extreme, but a person charged with murder with no bond is going to be in jail at least a year and a half, maybe two years in this jurisdiction, and so it’s very important that you do the bond hearing right the first time, so that hopefully you can have a bond set and you can be released on certain conditions and be out of jail/out of custody while the case is pending and you’re preparing for your defense.
