Many times, the ATF agent, or the Alcohol, Tobacco, Firearms agent, will put a hold on somebody who’s been arrested and charged with a crime. You usually see it on drug cases. Let’s say a person is arrested for state drug violations, they’re charged with drug crimes, and then they go in front of a state judge or state magistrate who then sets bond. Prior to posting the bond, and prior to the ability to get out of jail, they’ll be advised from the jail that someone has placed a hold on them. A hold is a term that means there’s a “hold for warrants” which means that other warrants are going to be obtained. An ATF hold would indicate probably that police allege that guns were found at the site and so the federal government is going to charge the person with some type of federal firearms violation which would prohibit them from having the ability to be released from state custody, so that they would have to go into federal custody and have the issue addressed over again, with the most likely outcome that they would be denied bond/denied release.
