Many times, people come to us if they’ve been arrested for what we called Criminal Domestic Violence (though now they’ve shortened it to just Domestic Violence). Domestic Violence is an Assault, it could be more or less the same as any kind of Assault & Battery – the difference is that the penalties are a little more severe and it involves, usually, spouses, but it could be someone that cohabitated, that had a child together, married couples. Those are people that are charged with Domestic Violence.
Usually, in that situation, the police get called (or one of the parties calls the police) and a lot of bad things happen as a result of that call. Sometimes people think that the Police are going to come and mediate and try to resolve the issue and tell the spouse to ‘act right,’ when in reality what they do is they arrest somebody and take somebody to jail. Sometimes they arrest both people and take them both to jail. Then, when the person gets out of jail, most of the time there’s a bond condition that they not talk to each other – not have any contact with each other. As a result of that, many times whoever the alleged victim is, whether it’s the woman or the man, they want to drop the case, and so we get the question: can they drop the case?
Well, the answer is: yes and no. The case is made by the police, by law enforcement, and so the person who is the alleged victim has a say in it as a witness. In most instances where one party regrets the police being called and wants to ‘drop the case,’ that can be arranged, but it’s a little more complex than maybe it should be. Certain things have to be done, but certainly that’s an option and something that, at the Complete Legal Defense Team, we’ve done many times is have those cases dropped either at the request of the wife or of the husband.
