Things that a person should know about settling an insurance claim are what we call liability. In other words, if you have a serious accident and it’s all your fault, then certainly in South Carolina, which is a fault state or negligent state, you’re not entitled to recovery, regardless of how seriously you’re injured, versus another person who caused an accident.

So, the three things you look at are:

• Liability; in other words, who’s fault is it?
• Damages; which means how seriously were you injured and how high are your medical bills, and then always
• Insurance coverage; is there insurance in place that will cover your injuries and your medical bills?
