If you’re charged with domestic violence and the case is pending then legally you’re presumed innocent. The state has the burden of proof, in other words, the state has to bring in witnesses which is usually going to be your boyfriend, girlfriend, or your spouse to testify.
If no one else saw the alleged conduct then there are no witnesses except for you and your spouse. If your spouse is unwilling to testify then many times those cases are dismissed or thrown out of court.
If a police officer observed it or another person observed it, in those instances they can be prosecuted. However, there are defenses to that and that’s something that you should be concerned about and take steps to protect yourself.
