One thing you need to know is that the penalties for leaving the scene of an accident generally mirror the penalties for driving under the influence. In other words, if you had an accident where no one was injured and you left the scene, the penalties are short jail time (30 days in jail, that sort of thing) which is the same as a DUI charge. If someone were injured or killed, then the penalty for leaving the scene, in South Carolina, is up to 15 years or up to 25 years, which is the same as the felony DUI charge. So, it’s very important to not leave the scene of an accident.
Once the police arrive, you have the right to take tests or not take tests, you have the right to make a statement or not make a statement. Again, if you ask for a lawyer, the police cannot question you. If you’re in the hospital, the police will come to the hospital – the same circumstances apply just because the police are investigating. You can make a statement or not – you can always make a statement later. If it turns out that you’re at your house, that you have left the scene and you’re at your house, and you go to the door, the police are going to arrest you. If you’re inside your house, legally they can’t come in the house to get you, okay? This is a big problem for most people, because most people go to the door, step outside, and then are arrested same as they would be at the scene.
