Bail in a criminal case is determined by the judge at a bond hearing, where a person is in front of the judge, hopefully with a lawyer present, and the judge looks at two elements: whether the person is a flight risk and whether the person is a threat to the community at large. And then the bail is supposed to be set at an amount to reasonably assure the person’s appearance back at court.
